Odisha Replaces Jail Terms for Gambling Offences With Fines
Odisha has taken a significant step in modernizing its legal framework for gambling. The Odisha Legislative Assembly passed the Odisha Jan Vishwas (Amendment of Provisions) Bill 2025, which eliminates imprisonment for gambling offences and introduces a system of graded monetary penalties. Minor violations now attract fines of Rs 5,000, while more serious cases can incur penalties of up to Rs 75,000.
Previously, offenders faced mandatory jail terms ranging from one month to six months, along with fines. The government stated that brief incarceration often fails to alter behavior long-term, while financial penalties offer a stronger deterrent. Officials also emphasized that the change will ease pressure on courts and jails, allowing law enforcement to focus on more serious crimes.
This reform aligns with the Union government’s Promotion and Regulation of Online Gaming Bill, 2025, which encourages e-sports and social gaming but restricts money-based games. Odisha’s decision highlights a broader national effort to update outdated legal provisions and modernize enforcement approaches.
The amendment has drawn mixed reactions. Opposition legislators have voiced concerns, suggesting that the move could encourage gambling and undermine safeguards against related criminal activity. Ruling party leaders, however, maintain that the change ensures transparent, practical, and proportionate enforcement. They argue the reform is a step toward a legal environment that reflects contemporary social and economic realities.
By replacing short-term jail sentences with financial penalties, Odisha aims to balance deterrence with efficiency, reflecting a progressive approach to legal reform in India’s gambling sector. The amendment underscores the state’s commitment to modernizing outdated laws while aligning with national initiatives for practical regulation and enforcement.
